Using WAZE... Is that illegal texting?

Using WAZE... Is that texting?

I got a ticket for VC 23123.5. (a) today when I was looking at the map that WAZE was displaying to me. I was stop at the off ramp of the freeway waiting for the light to turn green.

It is not illegal to read a map!!!

A map is graphics, not text.

I'm I wrong?

Electronic Wireless Communications Device: Prohibited Use

23123.5. (a) A person shall not drive a motor vehicle while using an electronic wireless communications device to write, send, or read a text-based communication.

(b) As used in this section “write, send, or read a text-based communication” means using an electronic wireless communications device to manually communicate with any person using a text-based communication, including, but not limited to, communications referred to as a text message, instant message, or electronic mail.

(c) For purposes of this section, a person shall not be deemed to be writing, reading, or sending a text-based communication if the person reads, selects, or enters a telephone number or name in an electronic wireless communications device for the purpose of making or receiving a telephone call.

(d) A violation of this section is an infraction punishable by a base fine of twenty dollars ($20) for a first offense and fifty dollars ($50) for each subsequent offense.

(e) This section does not apply to an emergency services professional using an electronic wireless communications device while operating an authorized emergency vehicle, as defined in Section 165, in the course and scope of his or her duties.

If you were not moving, you were not driving. You were stopped. IMO. Also, if they are going to say that this is illegal, then all in-dash navigation systems must also be removed from all cars in California immediately.

While California is at it, why don't they make all reading while driving is illegal? You should also get pulled over for reading reading road signs, what radio station you're listening to, which button is the "hazard" button, what gear your car is in, and the speedometer ("I don't know how fast I was going officer, because READING while driving is illegal"!) :x :roll: :shock: :x

I was not Pinging anyone. I was looking at the map the WAZE was display at me!


So looking at a Large Paper Map or a Large Map book is okay? ;^(
What logic is in that too?

UPDATE...

Had my case in court today.... :D

I fought the Law and I ...WON!!! 8-)

Judge even agreed that using WAZE is a GPS application and it's not texting , because it is a graphic based delivery system not using SMS which is texting.

Can I here a... AMEN? ;)

In the UK you don't have to be moving at all, it's illegal to text and/or use a non-hands-free phone even whilst in stationary traffic or stopped at lights!
And don't forget to apply your hand-brake while stopped at the light too!

I had a tap on the windows once whilst sitting in the passenger seat in a car park and starting the engine to warm the car! :(
