Removal of speed cameras following legal issues

Waze is not worth a single cent without a motivated community.

Why speak French law for Denmark, Germany and Switzerland?

Why not remove France as it is not legal?

You remove this feature but it will not change much because if users a danger signal indicating that it is a radar or police check it still makes it illegal Waze, do not you think? Ultimately ca allows you to remove the word warning radar in the presentation of the application, but in fact it is always possible to warn the users to radar.

Announcing such a change, just like it means nothing for the local community? Without having discussion with the local CM’s or telling them in advance? Just like someone made that decision in its lunch-break? Seriously?!

Waze is not a company, where your Boss is telling you how it goes. You define yourserelf as a community. People are working for waze without earning any money. I wouldn’t dare doing something, that could offend the community and if I were a CM, I would definitely feel offended and not taken seriously or treatet with the appropriate respect.

Even if it’s a google decision, its just the way you handled that issue, that makes me angry.

I’m just very disappointed about the way waze communicates in a situation like this.

I was ready to get into waze. But after this step, I will continue using Trapster.

First, I apologize for the post factum notification.
We should have definitely informed you before taking the action and not retroactively.

However, in this case we have been required to take prompt action in removing the speedcams due to law violation.

Unfortunately, in such cases, when legal issues are involved - we can’t open it to discussion. We have to operate in compilation with the law.

For the next time - we will make sure to keep you involved as soon as possible.

Moreover -

  1. the speedcams data is backed up in the data base so if we realize that it is legally possible to return them - we have all the data.

  2. We will keep checking if we can use the data in these countries in compilation with the law. If you can send us some concrete examples or suggestions - please let us know and we will look if there’s anything we can do about it.

Hi shirli,
Here is one concrete suggestion:

this is as if car manufacturers would decide to limit all cars top speeds to 130km/h because except Germany there is no country in Europe where it is allowed to drive faster :evil:

why not making it the same way TomTom does:
put a button in the options of the App to activate/deactivate the speed cameras and let the users decide themselves if they want to use it or not - it is their money if police catches them :wink:

Gadgets who’s only function it’s to warn the user(s) are illegal. When the function is beside the functionality as a navigation-system (optional) then there was never an illegal action.

Maybe Waze should crowdsource its legal support? Until then, the only way to get things done in Waze quick (to the better or to the worse) seems to be: forget uservoice, just send an order written in appropriate legaleeze.

A question to google:

Why you offer all other Apps with the same or especially Apps that were made only for this purpose like Trapster in your Store for our countries?

As usual, legal advice is available from a lawyer who has studied the national law of the respective countries.

However, if you have a look at the other manufacturers like TomTom, Garmin(Navigon), Alk et al, it is obvious that these companies have found legal advice that allows them to sell these services without violating he law.

The german law: Par. 23 Straßenverkehrsordnung:
(1b) Wer ein Fahrzeug führt, darf ein technisches Gerät nicht betreiben oder betriebsbereit mitführen, das dafür bestimmt ist, Verkehrsüberwachungsmaßnahmen anzuzeigen oder zu stören. Das gilt insbesondere für Geräte zur Störung oder Anzeige von Geschwindigkeitsmessungen (Radarwarn- oder Laserstörgeräte).

This is a server which hosts most german federal laws, paid by the government.

This is explicit in itself: Only a driver is not allowed to use devices which are dedicated to signal trafficsurveillance.

This is binding law for the driver of a car. Since this is not a crime but just a administrative offence, there is not even a punishment for cooperation, so Waze is not responsible for anything he driver does. According to german ADAC, the largest national motorist union, even a passenger would be allowed to use Waze in a car.

I can not comment on swiss or dansk law, but since other manufacturers have sold these services unharmed for years, the law must be similar.

In France, it is simple.

It is not allowed to show exact position of a fixed speedcam. Nothing, in the law, is related about policetraps, lightcam…

Software should alert about “danger areas”. These areas are avalaible for download on Government web site. Shirli, i’ll send you again my mail related to this.

If you read it even closer this Article is only about DEVICES which are made for: showing or disturbing traffic control. No word about Navigation Systems or even Software.

Just for the records, let’s keep the facts straight guys. Neither TomTom nor Navigon offer any type of warning in Switzerland, so there definitely is a legal issue there.
In Germany however, bot DO offer speedcam alerts. The details have been given here, there is absolutely no legal problem FOR WAZE in Germany.
